TIAC, Ministry of Constitution and Legal Affairs, TLS Convene Three-Day Conference on Commercial Dispute Resolution

Businesspeople and investors in Tanzania have been urged to make greater use of alternative dispute resolution (ADR) mechanisms to resolve commercial disputes, as a way of saving time and costs while preserving relationships between parties to contracts.
The call was made during a three-day training and conference organized by the Tanzania International Arbitration Centre (TIAC) in collaboration with the Ministry of Constitution and Legal Affairs and the Tanganyika Law Society (TLS) to raise awareness of alternative dispute resolution mechanisms.
Speaking at the conference, TIAC Board Chairman, Advocate Godson Hudson Nyange, said commercial disputes are a common occurrence that may arise during the implementation of contracts.
He said mechanisms such as arbitration, mediation and adjudication can help parties resolve disputes amicably without having to go through lengthy court proceedings.
Meanwhile, the Director of the Alternative Dispute Resolution Unit at the Ministry of Constitution and Legal Affairs, Felix Chakila, said the Government continues to establish systems aimed at creating a secure and conducive environment for both local and foreign investors.
Chakila said the mechanisms are intended to give investors confidence in the security of their investments in the event of disputes arising during the implementation of commercial contracts.
He noted that a lack of awareness among some members of the public and businesspeople remains one of the challenges hindering the wider use of alternative dispute resolution mechanisms.
He added that some parties are still accustomed to taking disputes to court instead of using negotiations, mediation or arbitration, which could enable them to reach mutually acceptable settlements.
The Ministry has also urged arbitrators and adjudicators in the country to ensure that they are fully registered and renew their licences on time so that they can perform their duties in accordance with the law.
The measure is aimed at strengthening integrity, professionalism and efficiency in the provision of alternative dispute resolution services in Tanzania.
The conference is part of initiatives aimed at strengthening the country’s business and investment environment in line with the goals of the National Development Vision 2050, by enabling the private sector to operate in a secure, transparent and predictable environment.
