Dr. Homera Urges Boards of Trustees to Avoid Misuse of Public Assets.

The Minister for Constitutional and Legal Affairs, Dr. Juma Zuberi Homera, has urged Boards of Trustees overseeing non-governmental organizations, religious institutions, sports bodies, and other community service institutions to refrain from misusing assets and engaging in unnecessary conflicts. Instead, he called on them to manage the assets of the institutions they lead with integrity, accountability, and in compliance with the law.

Speaking during the opening of a capacity-building meeting organized by the Registration, Insolvency and Trusteeship Agency (RITA) for Board of Trustees members and government officials from the regions of Katavi, Kigoma, Tabora, Mbeya, Rukwa, and Songwe, held at Home Alone Hotel in Katavi Region, Dr. Homera emphasized that trustees are obligated to perform their duties in accordance with the Trustees’ Incorporation Act, Chapter 318.

 He warned that the Government will not hesitate to take legal action against those who violate the law, misappropriate assets, embezzle funds, or unlawfully extend their stay in office contrary to their institutions’ constitutions.

“There is still a challenge of some Boards of Trustees failing to fully execute their responsibilities, using institutional assets for personal gain, engaging in embezzlement, illegally transferring ownership of assets, and overstaying their terms of office beyond what is stipulated in their constitutions, thereby causing conflicts and instability,” said Dr. Homera.

However, he commended the Administrator General and Chief Executive Officer of RITA, Mr. Frank Kanyusi, for the various measures he has undertaken to address and resolve challenges facing Boards of Trustees.

“I am aware that there are several long-standing disputes that have been submitted to my Ministry and other national authorities. However, I want all trustees to understand that appropriate legal and administrative measures will be taken against anyone who violates legal principles in the execution of their duties and perpetuates these conflicts,” he stated.

Dr. Homera further directed Boards of Trustees to submit their performance reports to RITA through the digital system and to amend their constitutions to align with current needs and institutional expectations.

He added that the Government, in collaboration with its institutions, is committed to ensuring that every organization is overseen by a Board of Trustees with integrity, competence, and the capacity to ensure that institutional assets and resources serve the interests of members.

Additionally, he instructed RITA to expedite amendments to relevant laws, continue improving the eRITA digital system, introduce Mobile Clinics nationwide to bring services closer to stakeholders, and enhance public education for trustees and the general public regarding their legal responsibilities.

Among other directives, Dr. Homera instructed RITA to conduct evaluations of its stakeholder meetings to identify emerging challenges and address them in future engagements.

 He also directed the agency to collaborate with other stakeholders to intensify public awareness campaigns on the importance of Boards of Trustees adhering to legal principles and regulations, as well as educating communities on their role in overseeing and ensuring accountability of trustees.

On his part, Mr. Frank Kanyusi stated that as of February 10, 2026, a total of 5,211 Boards of Trustees had been registered in the country. Of these, 2,876 are social institutions, 2,161 religious institutions, 19 political parties, 24 sports organizations, and 150 family trusts.

The Administrator General further clarified that trustees are entrusted with the authority to manage institutional assets for the benefit of members or beneficiaries in line with the objectives outlined in the respective institution’s constitution.

“This means that as a trustee, you are required to ensure that members’ assets are safeguarded and used strictly for the purposes specified in the institution’s constitution,” Mr. Kanyusi said.
